General terms and conditions of business


Dear customer

In order to guarantee a smooth cooperation with Stratos Swiss GmbH, based in Zurich ZH, we ask you to read these general terms and conditions. You therefore automatically accept these terms and conditions in full every time you order products or use our services. Your non-compliance releases us from all obligations arising from existing orders and contracts that have not yet been fulfilled.

1. Conditions & Offers

The prices to be paid by customers for services and products can be found in the contract document or the corresponding price list. All prices are stated in Swiss francs, EURO or US dollars and do not include VAT. Place of performance is Zurich ZH. The freight and packaging costs will be charged according to expenditure, including for subsequent deliveries. If the calculation basis changes, we reserve the right to charge the prices valid on the day of delivery. Special conditions and promotions on request, or by special agreement. Our offers are confidential in nature and may only be made available to people who actually process our offers. Price changes and errors subject to change.

2. Delivery

Stratos Swiss chooses the means of transport and shipping method. If the buyer/client requests something different, he will bear the additional costs. Partial deliveries are permitted. Unavoidable events such as force majeure, strikes, etc. entitle Stratos Swiss to postpone delivery or, if necessary, to withdraw from the contract. When the goods are handed over to the buyer/client, the benefits and risks are transferred to him. All delivery dates are non-binding. If the agreed credit limit is exceeded or payment is delayed, we reserve the right to stop delivery immediately.

3. Payment Terms

Unless otherwise agreed, all invoices are in Swiss francs, EURO, or US dollars payable within the agreed payment term printed on the invoice, without deductions. Checks are only considered payment when cashed. Offsetting counterclaims from the buyer is excluded. Warranty claims or alleged defects asserted by the buyer do not release the buyer from the obligation to pay. In deviation from the above payment conditions, Stratos Swiss reserves the right to only deliver goods against cash or advance payment and cash on delivery. This applies in particular to customers who are ordering from Stratos Swiss for the first time. No interest is charged on advance payments. Refusal to accept ordered goods does not release you from paying the purchase price. All reminder and collection costs as well as special expenses in the event of late acceptance or payment are borne by the buyer.

4. Liability for defects and compensation

Obvious defects must be reported immediately in writing, but at the latest within 3 days of receipt of the goods, and returned within 5 (five) days, otherwise the goods are considered approved. Liability for the costs of dismantling or reassembly as well as damages that arise directly or indirectly from the delivered goods (consequential damages) is rejected.

5. Guarantee

The guarantee periods for the different product groups are different. In principle, we pass on the manufacturer's warranty in full to our customers. If this information is missing, a guarantee period of 2 years applies from the date of delivery (date of signed delivery note or delivery receipt from the freight forwarder). Unless otherwise agreed, warranty cases will not be settled with credits. During the warranty period, Stratos Swiss will remedy demonstrably bad material or faulty workmanship free of charge, improve or replace defective parts. Excluded from the guarantee are damages resulting from improper handling, overloading, force majeure, improper use or natural wear and tear. Consumables are excluded from the warranty. The warranty obligation also does not apply if the purchased item has been modified or repaired without the consent of Stratos Swiss. The customer is responsible for freight, shipping and insurance costs for repairs. The material must be packaged in such a way that no electrostatic or mechanical damage is possible. If repairs are sent in that are not properly packaged, we reserve the right to reject the guarantee. For certain items, the warranty is handled directly by the manufacturer.

6. Repair conditions

Repairs will only be accepted with a correctly completed repair form (one form per item) and an accompanying copy of the invoice. To fill out the repair form, the repair software must be downloaded from our website www.elektrorollstuhle.ch/reperaturen. Only defective items without accessories will be accepted. For organizational reasons, any repair sent in that reaches us without a repair form or copy of the invoice will be returned at the sender's expense. For warranty reasons, submissions can only be accepted by specialist retailers. If, despite thorough inspection, the items sent do not have the defect described or are not covered by the warranty, we will charge a fee of CHF 38 per 15 minutes of working time. This also applies to items sent in that were not purchased from Stratos Swiss. In principle, no pre-warranty exchanges will be made. For items that are no longer manufactured or are not available, we must pass on the manufacturer's repair delivery time. Addition for electric scooters: Loss of warranty occurs when the housing is opened, the housing is damaged, or when used on wet roads or in the rain.

7. Severability clause

Should individual provisions of this contract prove to be invalid, ineffective or unfulfillable, this should not affect the validity, effectiveness and ability to fulfill the remaining parts of the contract.

In this case, the parties undertake to replace the invalid, ineffective or unfulfillable part of the contract with a valid, effective and fulfillable provision that comes closest to the original intention of the parties.

8. Return Policy

The return conditions only apply to Switzerland, as no delivery takes place outside of Switzerland. Returns must be made within 5 working days of dispatch to the address of Stratos Swiss GmbH. The condition of the product must be new and must not show any contamination or damage. Hygiene products such as seat cushions cannot be exchanged. For a return we charge 10% of the invoice value shown on the invoice. And we charge the actual costs we had for shipping to the customer. As well as any shipping costs from the customer to Stratos Swiss GmbH if we incur any.

9. Final provision

The customer accepts these terms and conditions in all points when placing an order by telephone, verbally or in writing. The place of jurisdiction for both parties is Zurich ZH. Only Swiss law applies. This edition of the General Terms and Conditions replaces all previous ones.
